Section 123
Court to uphold defendant

(1) If a person's right, interest, claim or concern is affected by the proceedings, hearing or disposal of a case even if no complaint has been filed against a person, if it appears that other persons are also involved in the complaint filed by the defendant or from the writing of the counter-answer submitted by the defendant. Or if for any other reasonable reason something needs to be understood with a person, the court may order such person to understand the reason.
(2) According to sub-section (1), if a person is to be understood, a period of seven days shall be given excluding the period of travel and if such person appears in the court within the period so given, his statement shall be made.
(3) If a person who has been understood according to sub-section (2) wants to give a statement in open evidence, the court shall record his statement and if he wants to submit a written answer, he shall be ordered to submit a written answer within seven days.
(4) If it appears from the statement or written answer as per sub-section (3) that such person is also concerned or involved in the matter of the complaint or if his rights, interests, claims or concerns will be affected by the decision of the court, the court shall keep him on the same date as the defendant.
(5) According to sub-section (3), if it appears from the written answer or statement made by a person that such person is merely evidence, the court shall not keep him on the date.
